Contract for Wedding Videography/Photography.
This is a legally binding contract between Wedding Memories/Andrew Roberts

Agreement:
“Wedding Memories” will provide services to film or photograph the clients wedding to the best of their ability.
Retainer and Payment: “Wedding Memories” shall reserve the time and date of the event upon receipt of the $500 retainer. No date is reserved until the retainer is received. The remaining balance due for services must be paid in full no less than 14 days before the event date. In the event that the client fails to remit payment as specified, "Wedding Memories" shall have the right to immediately terminate this Agreement with no further obligation, retain any monies already paid, and not attend this event.
Cancellation: Retainer is nonrefundable. If for any reason the client cancels this contract before the wedding date, “Wedding Memories” will keep the retainer. Rescheduled weddings will only be accommodated if the new date does not conflict with an existing booking. “Wedding Memories” will be the exclusive wedding videographers.
Creative aspects such as shooting and editing style are at the discretion of “Wedding Memories”.
“Wedding Memories” will not be held liable for any production problems beyond our control, Ex: bad weather, poor acoustics, lighting, interference from guests, etc.
Delivery: Films will be delivered digitally.
Drone Footage: We will be following CASA guidelines regarding aerial footage. We will only film with the drone if legal at the venue and weather permitting.
All or part of this video may be used by “Wedding Memories” for promotional purposes (social media platforms, showing it to prospective clients, etc).
Copyright: All video taken by “Wedding Memories” are their property, will remain their property, and are protected by the Australian Copyright Law. Client hereby waives any claims for ownerships, income, or editorial control.
Guests in attendance: Any guest present the day of the event may appear in the final film. We cannot accommodate requests to remove guests from the film.
Meals: Client agrees to provide videographers a meal at the reception during the time the Bride & Groom are eating. The videographers must eat as near to the time the Bride & Groom eat to ensure that they can be finished before toasts or any other reception events begin.
The Client assumes all responsibilities for obtaining any necessary permission, clearance permits, etc, which may be required for “Wedding Memories” to video each event, public or private. The Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions
“Wedding Memories” will not be responsible for coverage lost due to access restrictions. It is the clients responsibility to inform “Wedding Memories” of all timings and locations for the wedding day, if timings are changed it is the clients responsibility to inform Wedding Memories of updated timings.
The recording of the event, post-production editing, licensed music and the length of the final product are at the sole discretion of “Wedding Memories”. All creative aspects such as shooting and editing style are at the discretion of "Wedding Memories" the client acknowledges that they are familiar with the Company’s portfolio and is requesting services with knowledge of the company’s style. Accordingly, client acknowledges that the videos shall not be subject to rejection on the basis of taste or aesthetic criteria as they are familiar with the artistic style of "Wedding Memories". The client has critically viewed samples of “Wedding Memories” videography and photography work and hereby grants full editorial and production control to “Wedding Memories” for all aspects of the production and post-production services for the event. In the event a particular segment of the event is either not recorded, partially recorded, or not a part of the edited master tape, it is at the sole discretion of “Wedding Memories” as the exclusive producer of the events videography. Changes requested to the final video after delivery to client are charged at a rate of $120 Per Hour with a minimum of 2 hours charged. All raw footage can be purchased at an additional cost of $250.00 and delivered digitally.
Model release: The client hereby assigns “Wedding Memories” the irrevocable and unrestricted right to use and publish videos of the client or in which the client may be included, for trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The client releases all claim to profits that may arise from use of images. “Wedding Memories” will not be held liable for any production problems beyond our control, e.g. Bad weather, accidents, interference from guests etc. In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond “Wedding Memories” control, including but not limited to camera, hard drive, or equipment malfunction, “Wedding Memories” liability is limited to the return of all payments received for the event(s). The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. “Wedding Memories” is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or one year.
Working conditions: The client must provide a safe working environment and is responsible for any damage to equipment by guests. Shelter must be provided from rain, extreme temperatures, and humidity; in these conditions filming may be limited. “Wedding Memories” reserves the right to terminate this contract at any time for any reasonable cause, e.g. accident or ill health, in this event all monies will be refunded in full. Upon taking possession of the finished product, the client must inform “Wedding Memories” of any technical or other problems with their product within 7 days of receipt. After the 7 day period, if no notification has been received, the client will be deemed satisfied with the product.
Payment Schedule: The $500.00 non-refundable (save the date) fee is due at the time of signing of this agreement. The remaining balance is payable in full 2 weeks prior to the event(s). In the event the client fails to remit payment as specified, “Wedding Memories” shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not attend the event(s).
